HOW WE APPROACH A COMPLIANCE QUESTION

1

IDENTIFY THE QUESTION

Tell us whether the issue involves a transfer, firearm configuration, magazine, component or other shop service.

2

IDENTIFY THE FIREARM

We need accurate firearm and configuration information before discussing possible shop work.

3

REVIEW THE SITUATION

Requirements can vary by firearm, features, transaction and recipient circumstances.

4

EXPLAIN OUR PROCESS

We explain the FFL paperwork, dealer procedure or gunsmithing service applicable to what we can perform.

5

PERFORM THE SERVICE

When the requested work or transaction is appropriate, Ikkin Arms completes its dealer or gunsmithing role.

6

DOCUMENT THE RESULT

Required dealer records are completed and retained for transactions performed by Ikkin Arms.

NEW YORK SEMIAUTOMATIC RIFLE LICENSE

A Separate Requirement From SAFE Act Configuration Rules

New York requires a license to purchase or take possession of a semiautomatic rifle when the transfer of ownership occurs on or after September 4, 2022. For firearm dealers and custom rifle builders, that requirement changed who can take possession of a completed semiautomatic rifle in New York.

PURCHASE / TAKE POSSESSION

The license requirement applies to acquiring a semiautomatic rifle. A pistol license by itself is not sufficient unless it includes the semiautomatic-rifle authorization.

PRE-9/4/2022 OWNERSHIP

State Police guidance says a person who lawfully possessed a semiautomatic rifle before September 4, 2022 does not need this license merely to keep that rifle.

WHY IT MATTERS TO IKKIN ARMS

This licensing requirement significantly reduced the practical New York market for the custom semiautomatic rifles Ikkin Arms had built for customers. Call us before planning a new project or transfer.

Two different issues: SAFE Act rules address prohibited firearm configurations and features. The semiautomatic-rifle license addresses purchasing or taking possession of a semiautomatic rifle. A customer may need to consider both.

NEW YORK INFORMATION

New York Firearm Rules: More Than the SAFE Act

New York firearm compliance can involve more than firearm features. Depending on the transaction, customers may also encounter semiautomatic-rifle licensing, dealer-transfer procedures, background checks and other requirements.

Our SAFE Act reference remains available for configuration terminology. For semiautomatic-rifle acquisition questions, use the dedicated license guide above or call Ikkin Arms before arranging a transfer or custom project.

OUR ROLE

Ikkin Arms is a Federal Firearms Licensee and provides dealer and gunsmithing services.

We can explain the procedures and services our shop performs. We are not a law firm and do not provide individualized legal advice.

WHAT THIS MEANS FOR CUSTOMERS

  • Bring accurate information about the firearm and its current configuration
  • Call before arranging a shipment or unusual transfer
  • Expect required identification, paperwork and background-check procedures when applicable
  • Do not assume a configuration is acceptable because a similar firearm appears online
  • Ask before making a modification when you are unsure what shop service is appropriate

WHEN ANOTHER PROFESSIONAL IS NEEDED

Some questions go beyond the role of a firearm dealer or gunsmith. If the issue requires legal interpretation, advice about your individual rights or representation, speak with a qualified attorney.

If a government agency controls a permit, license, record or law-enforcement release, that agency may need to provide the authoritative answer or approval.

We would rather tell you which part Ikkin Arms can handle—and where you need a different resource—than give you an answer outside our role.
