MONROE COUNTY GUIDANCE

If the 15-Day Period Expires

Monroe County states that if the firearms are not lawfully transferred within the 15-day period, they must be turned over to a law-enforcement agency before they can later be legally transferred.

The County also explains procedures for firearms from an estate that are being held by the Monroe County Sheriff's Office. When firearms are held by another agency, that agency should be contacted about its procedure.

DO NOT ASSUME

A person being named in a will does not automatically eliminate firearm eligibility, licensing, possession or transfer requirements.

Estate counsel should address the estate-law questions. Ikkin Arms can address the firearm-dealer procedures for services we perform.

ESTATE FIREARMS INVENTORY

New York SCPA § 2509 provides that when a fiduciary or attorney of record is required to file a list of estate assets, the list must include a particularized description of every firearm, shotgun and rifle that is part of the estate.

Keeping a working inventory with the make, model, caliber or gauge, serial number and other identifying information can help the executor and attorney organize the firearm portion of the estate.

IF LAW ENFORCEMENT ALREADY HAS THE FIREARMS

Do not assume the executor can simply pick the firearms up. The holding agency may have specific release requirements.

Monroe County states that firearms held by the Sheriff's Office can be released to a firearms dealer in Monroe County after the Surrogate's Court appoints an Executor or Voluntary Administrator and the required paperwork is provided.

Call Ikkin Arms so we can understand which agency is holding the firearms and discuss the dealer side of the process.
